Why register a Trade-mark?

There can be significant consequences when a business fails to protect its trade-marks. Registration confers the right to the exclusive use of a trade-mark and it is in a business's best interest to establish such right and to be in a position to enforce it. The use of a trade-mark without the protection of registration makes a company susceptible to legal attack and it may ultimately be stopped from continuing such use if it is adjudged to be confusing with another's registered trade-mark.

Apart from the loss of goodwill and business momentum other major costs would quickly be incurred from costly lawyer bills, the (possible) immediate amendment of the business name, recall of the products, possible forfeit of profits, new clearance searches and re-marketing of the new company name or trade-mark, forms, packaging, directory listings, website, etc.!
